Acceptance of Agreement
The use of the Casa Vita Homewares website is governed by the following terms and conditions. By proceeding beyond this page you acknowledge that you have read and understood these Terms and Conditions. By purchasing an item from this Site and completing the registration process, you expressly agree to be bound by these Terms and Conditions.
Casa Vita Homewares reserves the right to update or modify these Terms & Conditions at any time without prior notice. For this reason, we encourage you to review these Terms & Conditions frequently. The goods displayed on this Site are available for purchase only by those persons over 18 and who have full capacity to enter binding contracts.
All goods and services displayed on this Site are for delivery in Australia and NZ only. We are obliged to deliver only to the address which you have specified and we will not be liable for any loss or damage which occurs because you are unable to take delivery at the specified address.
INFORMATION AND DETAILS
You are representing and warranting when placing orders on the Site that the information you provide is accurate, true and correct and are agreeing to indemnify us for any losses, costs and expenses or damages that we may suffer if any of this information is incorrect. If you are entering information on behalf of any other person, you must identify that other person. If any of Your Information is incomplete or inaccurate we reserve the right to decline any offer to purchase goods or services and terminate your access to the Site. In addition to our rights to terminate any access or transaction and to seek redress for any damage, you may be subject to penalties under Australian Criminal Law.
You must not attempt to alter any of the content on this Site or transmit or attempt to transmit any material of any kind to this Site which contains a virus, malicious computer code which is or is likely to be destructive of data or programming or other harmful component.
So that you have complete peace of mind when you decide to purchase any goods from this Site, your payment is arranged directly with the NAB bank using their NAB Transact - MOTO solution, this is a secure link to that bank. NAB is Payment Card Industry Data Security Standard (PCI DSS) compliant - where data is stored in a secure PCI DSS compliant environment to protect us both. NAB also takes your security seriously with secure 128 bit SSL encryption.

ORDERS
Purchase registration entitles you to be notified of benefits and periodic offers as a member of Casa Vita Homewares. You are encouraged to keep the box marked "I would like to receive updates from time to time from CASA VITA Australia" ticked in order to receive periodic offers and information which are kept specifically for purchasing members.
If you make an order it is deemed and constitutes an offer by you to purchase the quantity of goods or services (as the case may be) for the price (including the delivery and other charges) specified on this Site at the time you place your order. We reserve the right to accept or reject your offer for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this Site, or an error in your order.
Prices of products and services and delivery and other charges displayed on this Site are current at the time of issue, but may change at any time and are subject to availability. The availability of products and services may change from time to time.
We retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you on dispatch from our warehouse.
All prices are GST inclusive. For NZ deliveries you are responsible for any local taxes, duties or other liabilities imposed by any governmental agency, including without limitation, any customs duty, or any tax imposed by any government authority on any products or services acquired or ordered by you from this Site.
RETURNS
You agree to be bound by the terms of the returns policy set out in the "Delivery & Returns" section of this Site. The liability of Casa Vita Homewares with respect to returns is limited as expressed in this section and generally in these Terms and Conditions.
In brief, if the product is faulty, credit will be given against future purchases, or a money back refund will be issued at your option.
In order to obtain either of these options, the item/s must be returned within 14 days of dispatch, with a copy of the proof of purchase, the article/s must be in original perfect condition, unused, unwashed and not ironed. Please note that we will under no circumstances exchange or offer a credit note on items that are not in perfect condition or have been used, washed or ironed.
You must pay the cost of all return freight and insurance before the return will be accepted.
TERMINATION OF USAGE
We at Casa Vita Homewares reserve the right to withdraw your capacity to access all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, Associates, or Casa Vita Homewares. In addition, we reserve the right to refuse an order from any customer at our sole discretion.
Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately discontinue use of this Site and notify us by electronic mail, facsimile or post and terminate your Membership. Termination in these circumstances will take effect after our obligations to supply and deliver the goods and your obligations to pay for and accept the goods have been completed.
CREDIT CARD AND PASSWORD SECURITY
Casa Vita Homewares provides secure online services to approved users. Approved users are given a confidential user name and password. If you are given access to such services you agree to safeguard the user name and password you've been assigned. You authorize us to assume that any person using the site with your user name and password either is you or is authorized to act for you. You may only use or have access to Casa Vita's secure services only while you are an approved user.
Even though most banks limit your liability in certain circumstances, you may be held liable by us for fraudulent use of your credit or debit card if your actions have contributed to the unauthorised use of your credit card.
